Terms & Conditions

Welcome to Sugar Rush Confectionery postal website. If you continue to browse and use this website, you are agreeing to comply with and be bound by the following terms and conditions of use, which govern the Sugar Rush Confectionery relationship with you in relation to this website.

The term 'we' or 'us' refers to Sugar Rush Confectionery. The term 'you' refers to the user or viewer of this website. 

Our Guarantee

At the Sugar Rush Confectionery hub in Exeter, Devon we are committed to providing an excellent service and believe you should be delighted with your sweets. If you have purchased our products or received them as a gift and would like to contact us with your comments, please do so by contacting us via your chosen method of contact shown on the 'Get In Touch' tab.

The contract between us 

When you place a order with us, the order is only accepted once full payment of the product/products is received. Once your order has been accepted you will receive confirmation of this via the email you provided when placing you order. 

In the unlikely event that the goods are no longer available, or that we have made a pricing mistake, we will advise you of this as soon as possible. We do reserve the right to withdraw a purchase if it is placed based on a technical error relating to pricing or quantity issues. 

Price

The price of each product is clearly stated on the products at the time of you selecting them to add to your cart. The price will also be shown at point of check out. Prices do not include shipping costs unless a promotion states otherwise. Shipping costs are added at the checkout. 

We always do our best to make sure our prices are accurate and up to date but on rare occasions errors do occur. In this unlikely event we will contact you using the contact details you supplied us with, giving you the option of reconfirming your order at the correct price or cancelling it. If a product is cancelled under these circumstances any payments already made will be refunded. 

Shipping costs are stated and shown at the checkout, shipping is required to be paid for prior to your order being accepted unless a promotional discount has stated otherwise. 

Payment

Payment must be received in full before any orders will be despatched. We accepted most recognised credit and debit cards alongside PayPal payments. 

Our payments are taken through the secure system Stripe Card Services and PayPal. 

All options are secure and your credit card / debit card / PayPal details are securely encrypted and we do not see details of your card. 

Your credit or debit card company may do security checks called 3D secure which helps protect your card against unauthorised use and give you peace of mind whilst shipping online. Not every card provider will request this on every purchase you make. If they do it will take you to their own 3rd party window to confirm your details and again as this is something provided bye your card issuer we can not see or save any of these details. 

Availability 

We always try our best to make sure that we have plenty of products in stock but on some occasions for various different circumstances some products listed may actually be out of stock. 

If we cannot proceed a product which has been ordered, we reserve the right to substitute the goods with something similar. We may offer to send the product to you on a delayed order once the product arrives back in stock. Subject to you agreeing to waiting alternatively you may request a refund for the out of stock item. 

Allergens

At various points across our website we have stated the possible allergens you will find in our products. Our sweets MAY contain traces of NUTS. They WILL contain E NUMBERS, MILK, WHEAT and GLUTEN among other ingredients. Please make any ALLERGIES clear at point of ordering and a full list of ingredients can be provided. Not all sweets are suitable for young CHILDREN. Although we do not use nut products at the hub we would not recommend our product for somebody with nut allergies due to traces which can be found from the wholesale production line. 

Corporate Orders

We do accept corporate orders and large quantity orders however these orders must be paid for in full before despatch unless otherwise stated or agreed with a member of our team. 

Use Of This Website

Unauthorised use o this site mat give rise to a claim for damaged and or be a criminal offence. Occasionally this site will contain links to other websites which will have been provided for your convenience to give you further information. They do not signify that we endorse or accept responsibility for any content of any linked websites. 

Your use of this website any any dispute arising out of it is subject to laws of England, Northern Ireland, Scotland and Wales. 

Rights For You To Cancel Orders

We believe that you will be happy with you order from us but there may be occasions where you may have to return a product. If you feel a product isn't right you need to contact us within 3 days of receipt of the item. You will need to contact us via a method on the 'Get In Touch' tab with the reasons for your contact. From there a member of our team will help you further with any issues. The product if faulty will need to be kept as we reserve the right to request to see the problem in visual either in person if you are local or via picture forwarded to ourselves. 

If the order has not yet been despatched you can attempt to contact us and we can do our best to amend your order however this is not a guarantee. 

Cancellation By Us

We reserve the right to cancel the order if:

- We have insufficient stock to deliver the products you have ordered. If this was to happen we would contact you to advise of the options.

- Your delivery address is outside of our delivery area.

- If we do cancel your order for any reason we will notify you via the contact methods you provided at checkout as soon as possible and a refund will be credited back to your method of payment. No compensation for dissapointment will be offered.

We endeavour to keep this website up and running as effectively as possible. However, we take no responsibility for, and will nor be liable for, the website being temporarily unavailable due to technical issues beyond our control.

Delivery Methods and Timescales

We only offer delivery to UK mainland addresses. We use UK MAIL couriers to deliver our orders and this can be done on two different time scales. The price varied for shipping and you will see the options and prices at checkout. When 1-3 days is stated for standard delivery it means working days. We do not despatch on weekends or public holidays.

Please do not place a order expecting a guaranteed delivery scale as we cannot guarantee a time scale unless we have spoken with you and discussed delivery options in more detail.

We do not offer compensation for delayed, missed or damaged parcels. Refunds are at our discretion and only if we feel the matter is something that could of been prevented by us. 

Please not due to certain weather conditions throughout the year i.e heatwaves, snowy spells certain sweets such as chocolate and soft chew sweets may melt or become disfigured during the delivery process. During hot spells please place your order in a fridge or very cool place to bring your product back to its best. We do reserve the right to cancel or delay orders if we feel sending them out during such conditions could prevent the product reaching you in a useable state. We do not offer compensation for any orders which may reach you like this due to natural weather conditions. 

Delivery Of Products To You

At the hub we work very hard all year round to ensure your order leaves our premises within 2 working days of your order being placed. We do not despatch on weekends or public holidays. We cannot guarantee that your order will be sent within this specified time scale during busy and seasonal periods. Please order with enough lead-time as we will not be liable for any loss caused to you by late delivery.

We will deliver the products you have ordered from us to the delivery address you state and provide at point of checkout. It is your responsibility to provide us with accurate delivery information as we will not check or verify addresses and messages supplied by you. 

If UK MAIL try to make a delivery and you are not in, a card will be left to notify you of this. This card will provide you with the information you need to collect or re-arrange delivery of your item. 

Liability 

If the products you receive are not what you ordered, defective or the incorrect quantity, please contact us within 2 days of receiving the parcel. We will then correct any orders which are as a result of our mistake.

For example:

- Correct any shortage in quantity or non-delivery.

- Supply and deliver any substitute goods which we feel is necessary.

- Replace any defective goods that we feel are a result of a defect prior to leaving our hub.

 

- Refund or partially refund for items at our own discretion.

Please not that we cannot be held accountable for any damages caused during the postage process such as climatic conditions affecting the product. We make sure that all of our items are in perfect condition before they are sent to you. If your parcel does arrive in poor condition, please contact us and we can work alongside you and our courier to resolve any issues.

We will not be held liable to you for any indirect or consequential loos, damage or expenses (including loss of profit, business or goodwill). We shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the products in question at our own discretion. 

Neither us nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Events beyond our control

We shall have no liability for any failure to deliver products you have ordered or any delay in doing so or for any damage or defect to products delivered that is caused by any event or circumstance beyond our reasonable control. This includes without limitation to strikes, lock-outs and other industrial disputes, breakdowns or vehicles, systems or network access, flood, fire, explosion or accident.

Our Right To Cancel Your Registration

We reserve the right to cancel or suspend your registration effective immediately at our own reasonable discretion if you break any of the terms of these terms and conditions.

Any cancellation or suspension of your registration to this site will not affect either party's statutory rights or liabilities.

You acknowledge and agree to any terms laid out in our privacy policy. 

Governing Laws

The contract between us shall be governed and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.

Our online store contains products which is owned by or licensed to us (Sugar Rush Confectionery). These materials include our design, layout, looks, appearance, images, pricing but not solely limited to those mentioned. Reproduction on the same scale other than with copyright law is prohibited.
